Terms & Conditions for the sale of appliances

1 About this Contract
The www.towler-staines.co.uk is a service designed to allow you to select Appliances.

2 Interpretation
“TS” means Towler and Staines Ltd.
“Buyer” means the person whose order for the Goods is accepted by Us
“Contract” means the contract between the Buyer and TS
“Goods” means Appliances and Accessories

3 Price of Goods
All prices are Retail Prices and are inclusive of VAT at the appropriate rate

4 How do I Order and Pay?
By using our secure online order form or by telephoning the office direct.

5 Secure On Line Credit Card Transactions
This security certificate is intended to guarantee the identity of the remote computer

6 Delivery
The delivery charges for Appliances are:
Next working day delivery (Mainland UK ONLY)
Outside Mainland Great Britain
Orders should be made by 1pm Mon to Thurs to be delivered the next working day.
Orders made on Friday, Saturday or Sunday will be dispatched on the following Monday for delivery next day.

7 Cancellation
If you are contracting as a consumer you are entitled to cancel this Contract and receive a full refund for any reason at any time in the seven working days after the Goods are delivered to you. During that period you should take reasonable care of the Goods, including storing them in dry conditions and refraining from using them. In order to cancel Appliance orders you must telephone us 01535 682283 or e-mail gas@towler-staines.co.uk. All cancellation requests must be made within the period of seven working days mentioned above.

8 Refunds
In the unusual event that we deliver a faulty or incorrect Appliance we will replace it immediately. If this is not possible we will make a full refund of the purchase price.
Faulty Goods must be made available for collection within 30 days. Incorrect goods must be made available for collection within 14 days of receipt. If a refund is to be made please telephone our Customer Support Centre 01535 682283 for details of procedure.

9 Risk and Property
Risk of damage to the Goods shall pass to the Buyer at the time of delivery or, if the Buyer fails to take delivery of the Goods or fails to ensure that suitable access is available for the purposes of delivery of the Goods, the time when TS has tendered delivery of the Goods from which point TS shall bear no further responsibility for them.

10 Data Protection
To the extent that any data supplied by the Buyer to Towler & Staines whilst using the site is personal data, it will not be used by TS without the Buyers consent. The Buyer consents to TS using the Buyer’s personal data to administer and keep records of the buyers orders. TS will not pass the Buyers personal information to any third party for marketing or promotional purposes.

11 Termination
TS may end this Contract by notice to the Buyer in writing (such notice to have immediate effect), without affecting any other rights which it may have if:
except in the case of a genuine dispute, the Buyer has failed to pay any amount which the Buyer owes TS under this Contract or the Buyer commits any material breach of the terms and conditions of this Contract

12 Liability

12.1 Except in respect of personal injury or death caused by TS ‘s negligence and subject to clause 12.2, TS shall not be liable to the Buyer by reason of any representations, or implied warranty, condition or other term, or any duty at common law, or under the express terms of the Contract, for any consequential loss or damage, cost, expenses or other claims for consequential compensation whatsoever which arise out of or in connection with the supply of Goods or their use by the Buyer except as expressly provided in this Contract.
12.2 Where you are contracting as a consumer, no provision of these terms will affect your statutory rights.

13 General
The Contract and the construction, validity and performance thereof shall be governed by the laws of England and the parties hereby submit to the non-exclusive jurisdiction of the English Courts in respect of any dispute, suit or proceedings which may arise out of or in connection with the Contract.

14 Complaints Handling Procedure
All comments will be treated in the strictest confidence.
Queries are segmented by product type and appliance. This allows TS to track the nature of enquiry for each product range and improve our service where it is required.
Appliance queries receive a response within 48 hours from a named staff member who will be responsible for the status and processing of the query.
